A well-known Ellwood City funeral parlor owner was arrested Sunday after a woman told police he raped her while she was sleeping early Saturday.
Harold J. Marshall Jr., 51, is charged with aggravated indecent assault, indecent assault and indecent assault of an unconscious person. Mr. Marshall owns Marshall Funeral Homes and is the former president of the Ellwood City Chamber of Commerce.
According to an affidavit, the woman told police that she was having sex with her boyfriend at an apartment adjacent to Mr. Marshall's funeral home at around 3 a.m. Saturday when Mr. Marshall interrupted them to tell them that the lights were on in her boyfriend's car. Her boyfriend left the apartment to go shut off the lights.
The woman said she dozed off and then awoke to find Mr. Marshall on top of her sexually assaulting her. She pushed him off and ran outside, recounting to two friends what had happened. The friends told police they confronted Mr. Marshall, who allegedly admitted grabbing the woman's buttocks. She was taken to Ellwood City Hospital, where her clothing was taken for evidence.
Mr. Marshall was released on $10,000 bond. He faces a preliminary hearing Aug. 30.
Update:
Harold J. Marshall Jr., 52, of 200 Fountain Ave., was sentenced by Lawrence County President Judge Dominick Motto. In addition to probation, the sentence includes paying costs of prosecution, having no contact with the victim, undergoing a psychiatric or mental health evaluation and being in compliance with any recommendations.
Initially charged with aggravated indecent assault, indecent assault and indecent assault of an unconscious person, Marshall pleaded guilty to indecent assault in December.
